All Rights Reserved. *Erie County, Pennsylvania Phone No. (814) 725-4347 AGREEMENT AND CONDITIONS OF PURCHASE Trinity At Pine Grove Judy Ann Cook (814) 725-4347 Email: TheWindMariah@hughes.net Date:______________________ Breeders/ Sellers: Judy Ann Cook Buyer(s): ______________________________________________ Puppy's Identification:______________________________________________________ _________________________________________________________________________ (1) The Breeder and the Buyer, as stated above, have entered into an agreement to transfer the ownership of the dog/puppy identified above hereafter referred to as the “Dog”, and agree to the following conditions set down for the best interests of the breed, the protection of the dog, and the reputation of Trinity at Pine Grove and said owner/seller. Such basic conditions are as follows: (2) The above stated dog(s) transferred to the buyer(s) shall not be a kennel dog. Meaning, it will not reside in a confined structure, or pen on a permanent or a routine basis. Buyer(s) agree that this dog shall not be routinely affixed or chained or fastened to objects that would hinder the dog(s) freedom of mobility, but said dog shall be able to move freely in an adequate protected area and safe from harm from persons or harmful situations and non-family members. (3) The purchaser must have the dog examined by a licensed veterinarian within three business days of the purchase. (4) If the examination indicates that at the time of sale, said dog was unfit for purchase due to illness or disease, you may return the dog to us for an exchange of equivalent value. (5) If within one (1) year from the date of purchase from Breeder a dog is found and certified by a licensed veterinarian to have a hereditary disorder which adversely affect the health of the animal, and if Breeder is notified within two (2) business days of the veterinarian’s determination, we will provide a replacement puppy of equivalent value. However, Breeder will not be responsible for veterinarian fees or costs or travel expenses. If this dog is of good quality for breeding and the new owner decides to breed it is recommended that this dog have all the test necessary to assure good healthy pups. There are several breeds of dogs that are more susceptible and sensitive to anesthetic so it is advised to run all preliminary test before any surgery is preformed. (6) There is no guarantee or warranty that the purchaser will be able to show or breed the pet. (7) In the event of any litigation in connection with this Guarantee, Breeder will be paid reasonable attorney fees by the purchaser. Venue and jurisdiction for litigation arising out of or related to this contract shall occur exclusively in the County of Erie, State of Pennsylvania. (8) Registration papers for all registered puppies or dog(s) will be sent by regular mail. If the papers are lost, the purchaser is responsible for the cost of obtaining new papers. However, we will assist you by providing a copy of these papers. (9) This guarantee is non-transferable. The dog must be in good physical condition. No replacement will be given if the female has been bred. No replacement will be given if breeds that are known to be prone to hip dysplasia are over weight or over exercised. No replacement if the registration application form has expired. You must follow the Breeder recommended nutritional program, including recommended dog food and vitamin supplement listed on your Puppy Instruction Form included in your packet. All mentioned conditions must be met or all guarantees above will be void. All laboratory verification must be done by a licensed veterinarian. The owner is responsible for transportation costs to and from the Seller. Seller is not responsible for any and all veterinarian expenses accumulated on returned or replaced dog or puppy. Seller sells pets for companion purposes only. (10) I, the purchaser of a dog(s) from said Breeder hereby acknowledge that I have received a copy of this document as well as described herein pertaining to my pet’s health inspection signed by a licensed veterinarian. Further, I accept the terms and conditions of the guarantee for congenital or hereditary disorders printed in this document, and I waive and relinquish any and all other rights that I might otherwise have in the event of such occurrence. The purchaser acknowledges that he or she has read, understands and agrees to the terms of this document. I / We, the buyer(s) certify that I / We have never been found guilty and/or plead to any type of cruelty to animal criminal charges nor do I / We have anyone living in our residence that has been found guilty and/or plead to said criminal charge (where said dog(s) will be living) that is not a party to this contract I / We, the buyer(s) do agree that by purchasing this dog(s), said dog(s) will not be used to fight any other dog for profit or by any other illegal means.
